Questions your lawyer will ask you during a divorce
Divorce is the final chapter to a marriage. It isn’t easy and can be very complicated to those involved. Sadness isn’t always a word associated with divorce. It clearly depends on the circumstances and if children are involved.
If you want to end a marriage and have no idea where to begin, You are in luck. There are a few set questions your lawyer will ask. These questions will help determine how to file for a divorce and whether or not you can file for an annulment or a divorce.
Questions –
Are you and defendant living together? The lawyer needs to know if you and the respondent are currently living under the same roof.
Any children of the marriage? If there are no children born out of the marriage, then this question will not pertain to you. Children in the marriage will further require additional information to proceed with the divorce.
Describe relationship with soon-to-be ex. The relationship with the soon-to-be ex needs to be disclosed to the lawyer.
How long have you been separated? The length of the separation is a key question for a lawyer to ask their client.
How long have you lived apart? In some states, you must be living apart before a petition can be filed.
Date of separation. This date is important to know. The exact time frame doesn’t have to be known. But a general idea of the date is required.
Who left whom? This question isn’t too important, but it can be vital information to help the proceedings move a little faster.
Violence? Verbal or physical? The status of the relationship is a necessity. Your lawyer can request a protection order if any abuse existed in the marriage. A protection order will keep you safe and protected.
Properties together? Properties in a marriage can be divided equally for the most part. If there was a prenup, the properties may not be able to be divided equally.
Lawyers tend to swarm their clients with questions. These questions may seem unnecessary at the time, but they are vital to the divorce proceedings.
